New Data Privacy Framework: A new data protection agreement between the EU and the USA from this summer will simplify data transfers to the USA in future. The current framework fulfils the Commission's requirements for the legally compliant transfer of personal data - among other things, access by US intelligence services to the data of EU citizens is now restricted; there is also an efficient way to take legal action in the event of violations.


It is important for you as a company to have valid certification for all external tools and plugins on your website that transfer data to the USA. Only if they have undertaken to comply with detailed data protection obligations in the USA can they be used without hesitation. The following also applies: User consent - for example via cookie banners - is still required for legally compliant data use!

New data pact

In July, the European Commission published the new data protection agreement between the EU and the USA. In line with the Commission's requirements for the legally compliant transfer of personal data, this version restricts the access of US intelligence services to data of EU citizens and provides for the possibility of legal action in the event of violations.

What does this mean for you as a company?

In principle, this makes data transfer easier. However, caution is still required, because: US companies must first join this framework. All external tools and plugins on your website that transfer data to the USA must therefore be certified in accordance with the Data Privacy Framework! Important: Users must still consent to the use of their data, e.g. via a cookie banner.
