TMG
becomes DDG

DDG in action!

The new Digital Services Act is here: website operators must act. Since 14 May 2024, the Digital Services Act (DDG) has replaced the Telemedia Act (TMG); the Telecommunications Telemedia Data Protection Act (TTDSG) has been renamed the Telecommunications Digital Services Data Protection Act (TDDDG).

Changes for website operators

There is now a need for action for (almost) every website operator: In order to avoid possible warnings, the legal notice, cookie banner and privacy policy must now be checked to ensure they are up to date. The obligation to provide an imprint now results from DDG § 5 instead of § 5 TMG as before. Regulations from the TTDSG can now be found in the TDDDG.

Need for adaptation, e.g. in the imprint

The DDG brings national law into line with the EU's Digital Services Act (DSA). The DSA focuses on two areas:

  • Promoting the smooth functioning of the internal market for intermediary services
  • Supporting a trustworthy, predictable and secure online environment

Who is affected by the changes?

The legal restructuring affects providers of digital services as well as all website operators. The following applies: Anyone who previously had to provide an imprint is still obliged to do so under the DDG. All information and the privacy policy as a whole must be up to date.
